There are plenty of instances where the court has decided to try a minor as an adult, and almost every time the public gets angry, demanding to know why this child should be tried and sentenced more harshly than another one. Many people do not know what the process is to get a juvenile charged as an adult.

The first thing that must be understood is that the law in all states vary about when it is legal to charge a child as an adult. In general, however, the law that was broken is usually very heinous and possibly cruel. Those children who are repeat offenders of criminal acts are also occasionally charged as an adult.

In some states, the judge is the only one who has the ability to charge the child as an adult during a court case, while in others the prosecuting attorney is legally allowed to adjust the charges. If the judge feels that the change is unnecessary, he will almost always deny the motion to bring adult charges on a minor.

Children who are charged as adults will deal with adult penalties. In most cases children who are charged as such will deal with less stiff sentences, and sometimes a child is let loose after they served a very small amount of time, simply because they are a child. A child who commits murder, for instance, may be allowed to leave the legal system in just a few years, as compared to an adult who is found guilty of murder and may have to spend half of his life behind bars.
